If you are dealing with creditor harassment, whether in the form of incessant phone calls or threatening letters, the federal bankruptcy laws can help, even with foreclosure actions. Under the laws, an automatic stay goes into effect immediately upon the filing of a Chapter 7 or Chapter 13 petition. The automatic stay prohibits your creditors from calling, writing or pursuing legal action (outside of the bankruptcy proceeding) to recover any debt. This includes mortgage obligations.

In a Chapter 7 filing, you are allowed to permanently discharge certain debt in exchange for the sale of nonexempt assets. While a Chapter 7 filing will suspend foreclosure proceedings, you cannot discharge the debt on your home and still keep the property. If Chapter 7 appears to be the best option for you, we will work with you to discharge those debts that are permissible so you can afford to make your house payments.

In a Chapter 13 proceeding, you enter into new payment arrangements with your creditors, agreeing to pay off debts under new terms over a three- to five-year period.
