Kim Kardashian and Kanye West announce pregnancy

During his latest concert, rapper Kanye West made headlines with another big announcement when he stopped his show and said “stop the music and make noise for my baby mama!” The crowd roared in excitement and Twitter went crazy with the big news…Kim Kardashian and Kanye West will be having a baby together in 2013.

On December 31st, Kim personally announced the news on her blog, saying “It’s true!! Kanye and I are expecting a baby.” She also expressed her excitement of having a new addition to her family and that she would be looking forward to the New Year and new beginnings.

The two have been dating since April 2011, even as Kim is still mired in a messy divorce with Brooklyn Nets Forward Kris Humphries. Rumors of her pregnancy spread after she was spotted leaving an OB-GYN’s office last week, reportedly due to morning sickness symptoms.

While the story will produce the New Year’s first major headlines, it certainly carries some interesting legal issues. Since Kim is still legally married to Kris Humprhies, he is (legally) presumed to be the father until Kanye petition’s the court to establish paternity. As a matter of law, when a child is born to a married woman, the husband is presumed to be the father.

It is safe to assume that Humphries is not involved in this pregnancy, as the couple has been separated since their wedding debacle became public. Nevertheless, the story is a interesting reminder of how paternity is treated differently between married couples and those who are not married.
