Keeping the best interests of the child at hand when divorcing

In most cases, marriage in Ohio is intended to last until “death do us part,” but there are occasions when its duration is not so lasting. Reasons for splitting up are many and can range from incompatibility to infidelity and everything in between. With a recession behind us and an economic recovery at hand, divorce and related issues, like child custody and spousal support, are sometimes handled differently than in years past.

A young couple with a 5-year-old son recently discussed their living situation. The family lives together in a rented home in Arlington and the parents have decided to divorce, but rather than live in separate homes the two have decided to live in separate bedrooms. Fortunately, the rented home has three. The mother and father take a turns taking their son to and from school and caring for him at night so the other can socialize with friends.

Apparently their living situation is something that is happening with more frequency across the country—so much that it has a name: nesting. This particular couple mentions that they were against dampening the boy’s perception of a complete family unit, so rather than separate and live in two different dwellings, they divided up their home and live in separate rooms. The arrangement also has some economic appeal.

There are a number of reasons why a couple may decide to split. While the reasons are many and varied, there are also a number of living situations that may make sense to a divorcing couple. When people have child custody questions as they are working through a divorce, it may be helpful for them to speak with an experienced attorney.
