Caution: Police plan drunk driving checkpoint on Rt. 23 tonight

It is a fact of science that it is impossible to say that a certain number of alcoholic drinks puts a person over the 0.08 percent legal threshold for drunk driving. Every body metabolizes alcohol a little differently. It could take one person a single beer and someone else three. Because of the discrepancy, the adage says don't drink and drive at all.

There is no legal debate about the validity of the standard. If police in Ohio are able to gather evidence that indicates a driver is at or over the 0.08 percent mark, charges of operating a vehicle impaired can be expected to follow.

Conviction on even a first offense can mean that a person runs a risk of being sentenced to time in jail and suffering a suspended driver's license. There is so much at stake that anyone who faces the possibility of an OVI charge should take it seriously.

This is something that drivers in Delaware County are wise to keep in mind all the time, but perhaps more so tonight. That's because the State Highway Patrol and deputies of the Delaware County Sheriff's Department plan to be out in greater numbers patrolling for drunk drivers.

They have announced that they will be operating an OVI checkpoint somewhere along Route 23 north of Columbus between 9 p.m. and 1 a.m. The specific location of the stop zone hasn't been made public. Highway patrol officials say that in addition to the checkpoint, extra cruisers will be on patrol.

Most drivers likely have a notion of what procedures police follow when making a stop for suspected OVI. What they may have less notion of is what their rights are in the event of a stop. And that's why contacting an attorney is always recommended.
