Child visitation argument turns violent

When a couple contemplates divorce, there are many facets to consider. Financial obligations, dividing the estate and child custody issues are just a few. While facing the realities of a split can be challenging enough for the two people who are divorcing, they also bring challenges to children when they are involved.

This is the story of an ex-husband, his former wife and her current boyfriend, all of whom were involved in an argument regarding visitation rights. The ex-husband returned his daughter home to her mother, his ex-wife, where he and the ex-wife’s boyfriend engaged in an argument outside that turned violent. The ex-husband threw the first punch and the allegedly intoxicated boyfriend drew a gun. The ex-wife was recording the event with her cell phone camera as it unfolded and was accidentally shot by her ex-husband after he had confiscated the gun from the boyfriend.

Although the wounds from the gunshot were not life threatening, the ex-husband was charged with negligent assault and the boyfriend was charged assault and possession of a weapon while intoxicated. The woman received medical treatment at a local hospital. It is unclear if the child was present to witness the events, but the camera was rolling.

There are a lot of things to consider when a couple divorces. When children are involved, the courts generally make custody assignments that they deem are in the best interests of the child. When modification to such assignments is desired, it may be wise to seek counsel from an experienced attorney.
