Abuse allegations made prior to child custody modification

On Behalf of | Nov 12, 2013 | Child Custody |

Data taken from CDC census numbers revealed that divorce occurred at a rate of 3.6 per 1,000 people living in the United States in 2011. Divorce is something that occurs not only in Ohio, but around the globe. One of the issues that divorcing couples with children have to face is that of child custody.

A 12-year-old Beverly Hills boy filed a request for restraining order against his father, a prominent plastic surgeon. The boy’s father and mother, who is also a prominent plastic surgeon, had started the divorce process and were scheduled to enter the courts for child custody issues. The boy accused the father of inappropriately touching his younger siblings, physical violence and threatening the lives of the kids and their mother.

The father denies the accusations that were made by his son. Authorities investigated the matter and apparently found no proof that the son’s allegations were true. In the custody hearing, the courts granted the father legal custody of the couple’s four children. It appears, however, that the mother will have physical custody of the son who filed the restraining order request. It is unknown if the child who made the allegations against his father did so under the direction of another person as a way to foster sympathy in the custody modification.

Divorce is something that happens globally. When a divorcing couple has children, they will likely have to make a custodial arrangement before the split is finalized. Speaking with an experienced attorney may be helpful in arranging custody and visitation rights.
