Do I have the right to a court-appointed lawyer?

As you may already know, the U.S. Constitution affords citizens many rights, including the right to an attorney in some situations.

This right was further defined in a 1963 Supreme Court case when it was held that free legal representation is necessary for defendants in criminal cases when they cannot afford to hire a private lawyer and they face the possibility of incarceration.

Therefore, if you have been charged with a criminal crime, you face incarceration and you do not have financial means to hire a private attorney, you may be able to ask to have a public defender assigned to your case.

However, even if you can qualify for a public defender, you may still want to choose to hire a private criminal defense lawyer for a number of reasons.

Primarily, even though many criminal defense lawyers are good at what they do, they carry such heavy client loads that your case will not get the attention it deserves. Public defenders have little time or energy to spend investigating the case and looking into all possible lines of defense.
